1. Acceptance of these terms

By creating an account, listing a sale, contacting a seller, or otherwise using Sellabout (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract. By using the Service, you represent that you meet these requirements and that all information you provide is accurate.

3. Your account

You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access. We may suspend or terminate accounts that violate these Terms.

4. Ownership of items

By listing an item on Sellabout, you represent and warrant that:

  • You are the lawful owner of the item, or you are authorized to sell it on the owner's behalf;
  • The item is free of liens, security interests, or other encumbrances that would prevent sale;
  • The item is not stolen, counterfeit, recalled, or otherwise unlawful to sell;
  • Your description, photos, condition, and price accurately reflect the item.

5. Legal & prohibited items

All items listed must comply with applicable federal, state, and local laws. You may not list, offer, or sell:

  • Firearms, ammunition, explosives, or regulated weapons;
  • Illegal drugs, controlled substances, or drug paraphernalia;
  • Alcohol, tobacco, vaping products, or cannabis (where prohibited);
  • Prescription medications, medical devices, or supplements requiring a license to sell;
  • Recalled products, counterfeit goods, or items that infringe intellectual property;
  • Hazardous materials, asbestos, or unsafe children's products (e.g. recalled cribs, drop-side cribs);
  • Live animals, animal parts, or items made from protected species;
  • Human remains, body parts, or bodily fluids;
  • Stolen property or items you do not have the right to sell;
  • Government IDs, badges, uniforms, or law-enforcement equipment;
  • Any item prohibited by your local jurisdiction.

6. No offensive or harmful content

Listings, photos, titles, descriptions, profile content, and messages may not contain material that is: hateful, harassing, threatening, sexually explicit, promoting violence or discrimination, defamatory, invasive of privacy, deceptive, or otherwise objectionable. We reserve the right to remove any content and suspend any account at our sole discretion, without notice.

7. Transactions between users

Sellabout is a listings platform that connects sellers and buyers. We are not a payment processor and we are not a party to any transaction between users. Buyers pay sellers directly using the seller's preferred personal payment method (e.g. Zelle, PayPal, Venmo, Cash App, or cash). Sellabout never collects, holds, or transfers funds for item sales, and does not provide escrow, refunds, warranties, or guarantees on items sold.

Sellers are responsible for the legality, accuracy, quality, and delivery of their listings. Buyers are responsible for inspecting items before paying, arranging pickup, and paying any taxes that apply. Buyers and sellers agree on terms (price, hold time, payment method, pickup) directly through Sellabout's messaging feature.

7a. Disputes between buyers and sellers

Because Sellabout does not process payments, we cannot reverse, refund, or mediate the financial portion of a transaction. If a dispute arises, contact the other party first through the in-app messaging feature. If you paid through a third-party app (Zelle, PayPal, Venmo, Cash App), use that app's built-in dispute or buyer-protection process where available.

Sellabout reserves the right (but has no obligation) to suspend accounts and remove listings for fraud, policy violations, or harmful behavior.

8. Safety

You meet other users at your own risk. Use common sense: meet in well-lit public areas where possible, bring a friend, do not share unnecessary personal information, and trust your instincts. Sellabout does not screen, vet, or perform background checks on users.

9. Fees and subscriptions

Some features require a paid subscription. Fees are billed in advance and are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period. Payment processing is handled by third-party processors and is subject to their terms.

10. Disclaimer of warranties

THE SERVICE AND ALL LISTINGS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. YARDKIT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY LISTING, USER, OR ITEM IS ACCURATE, GENUINE, SAFE, OR LAWFUL.

11. Release & limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE YARDKIT, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, AND AFFILIATES (THE "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING ATTORNEYS' FEES) ARISING OUT OF OR RELATED TO: (a) any listing, item, transaction, dispute, or interaction between users; (b) any in-person meeting, pickup, or sale; (c) any injury, death, property damage, theft, fraud, or other harm caused by another user or by an item sold or purchased through the Service; (d) any content posted by users; (e) your use of, or inability to use, the Service; or (f) any unauthorized access to your account or data.

IN NO EVENT WILL THE RELEASED PARTIES' TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (i) the amount you paid Sellabout in the twelve (12) months preceding the claim, or (ii) USD $100. THE RELEASED PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) any item you list, sell, or buy; (c) your violation of these Terms or any law; or (d) your infringement of any third-party right.

13. Content license

You retain ownership of the content you submit (listings, photos, descriptions). By submitting content, you grant Sellabout a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content for the purpose of operating and promoting the Service.

14. Termination

We may suspend or terminate your access at any time, with or without cause or notice. You may stop using the Service at any time. Sections that by their nature should survive termination will survive (including ownership representations, releases, indemnification, disclaimers, and limitations of liability).

15. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which Sellabout is established, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the courts located there, and you consent to personal jurisdiction and venue in those courts. To the extent permitted by law, you waive any right to a jury trial or to participate in a class action.

16. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time without notice or liability.
